Feds to investigate 65 restaurants in Utah for compliance -

The U.S. Department of Labor is investigating 65 restaurants in Utah this year in an effort to combat federal law violations on minimum wage, overtime pay and child labor.

The restaurant industry in Utah was identified by the department's Wage and Hour Division as one that needed to step up compliance with the Fair Labor Standards Act.

"Historically, we have found that restaurants tend to have higher violation rates than other industries in Utah, because there may be a lot of young, low-wage workers who may not understand what their rights are, and small business owners who aren't aware of labor law regulations," said Lee Ann Dunbar, the Wage and Hour Division's district director in Salt Lake City. CHANGES IN EMPLOYMENT SELECTION

During the last legislative session, the Utah state legislature passed the Employment Selection Procedures Act, which became effective May 12, 2009. This law, which applies only to companies with 15 or more employees, was subsequently amended in the Special Session in mid-May to make some key changes.

The law is designed to protect the privacy of job applicants, and to safeguard the information that employers collect during the application process. Because this new law makes fundamental changes to when an employer may request certain information during the application process and how long it may keep the information once it has been obtained, it is critical for employers to understand it. Sandy's Little Caesars franchisee fined

 Hiring child labor can be very expensive.

Caesars Utah LLC, a Sandy-based franchisee with 48 Little Caesars Pizza restaurants in Utah, paid $110,800 in civil penalties to settle child labor violations at nearly half of its restaurants, a federal regulator announced Thursday.

Dean Campbell, district director of the U.S. Department of Labor's Wage and Hour Division in Salt Lake City, said a federal investigation found a total of 138 minors were hired by 20 franchised restaurants including four in Payson, Springville, Saratoga Springs and Draper. MORE...
